Terms Of Use"We", "Our" and "Us" refers to Housesonline Australia Pty Ltd ACN 099 732 117. "You", "Your" refers to you as the user of this online house sale service utilising www.housesonline.com.au ("Our Website").
Our web site is operated under licence from HOL Holdings Pty Ltd ACN 107 226 504.
Your use of the information, graphics and materials on Our Website is governed by these standard Terms of Use and the Privacy Statement.
By using Our Website You are expressly agreeing to be bound by these Terms of Use.
General
1. Period of Internet Listing
Your property shall be listed on Our Website within approximately 48 hours of Us receiving full payment from You and will remain on the website for the duration of the listing authority.
Should Your property be listed with with any other real estate agent, then the Housesonline “For Sale” sign shall be removed and the property listing will be deleted from Our website together with any other third party websites officially linked to Our Website.
2. Signs
Your placement of the Housesonline “For Sale” signs and “Open for Inspection” signs on Your property must conform with any legislative requirements, including but not limited to local shire council signage regulations. It is Your responsibility to ensure that these legislative requirements are adhered to at all times. These signs are only to be displayed at the property listed on Our Website and must be returned to Us when the property has been sold or withdrawn.
3. Advertising and Refunds
All advertising shall contain reference to Our Website and the Website code number. The pro rata portion of prepaid advertising costs that has not been used prior to the withdrawal or sale of Your property shall be refunded less Our reasonable costs. Refunds for any other product and/or service will be at Our discretion and based on the level of work completed and costs incurred.
4. Email and Telephone Enquiries
All email and telephone enquiries will be forwarded by Us directly to You and it is Your responsibility to follow up any enquiries passed on by Us. . Any complaint should be initially directed to Our local Area Consultant and if a satisfactory resolution cannot be achieved, it can be submitted in writing to Our Managing Director, Russell Robertson, on email: sales@housesonline.com.au. 5. Payment
Payment can be made by Cash; Cheque (Subject to clearance); Visa, Bankcard, and MasterCard; or by Direct debit.
6. Property Listed
The property listed is restricted to one property although an additional lot may be included if on the same registered plan as specified by the Department of Natural Resources Mines and Energy (or the appropriate department). Multiple property listings by You will be subject to agreement with Us.
7. Archiving of Properties
Once Your property is sold or withdrawn from the market it is removed from all websites and archived. You must notify Us within 72 hours of Your property being sold.
8. Confidentiality
The contents of the information supplied by Us to You shall be kept confidential to all extents possible. You must not reproduce or use any information We provide to You or which You have obtained from Our Website without Our consent or as permitted by law.

9. Third party websites
Our Website may contain links to other web sites operated by third parties. We do not endorse, or approve of the operators of third party web sites, or the information, graphics and material on such sites. Further, the information on Our Website may be displayed on third party websites officially linked to Our Website.
10. Intellectual Property
All items purchased in any package and/or any selected optional extra (including floor plans and virtual tours) remain Our intellectual property. We own and retain all proprietary rights to Our Website and the intellectual property, products and the services we provide. You may not sell, transfer, assign, licence, rent or loan any of these products and/or services without Our written consent.
11. Accuracy of information
Whilst We make all reasonable attempts to ensure the accuracy of information and photographs supplied on Our Website, We do not accept any responsibility or liability for any failures or inaccuracies. Specifically, We make no warranty or representation regarding the quality, accuracy, merchantability or fitness for purpose of the services We provide on Our Website or that access to Our Website will be uninterrupted.

Subject to any responsibilities implied by law and which cannot be excluded, no member of the Housesonline group is liable to You for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever arising out of or referable to material on Our Website or to third party material.
